If you are in a relationship with an Australian citizen, Australian permanent resident, or eligible New Zealand citizen and wish to live in Australia with your partner, a Spouse Visa could be suitable for you.

To qualify, all applicants must demonstrate that their relationship is genuine and ongoing. This can be shown through financial commitment, social acceptance, emotional support, and the nature of your household.

You may be granted a temporary visa while your permanent visa application is being processed. A permanent visa may be granted if your relationship is still ongoing two years after applying for the Spouse Visa. In some cases, you may be eligible for the permanent visa directly, depending on factors like establishing a long-term relationship or having children.

Partner Visas are available for both married couples and de facto couples. For married couples, the marriage must be recognized under Australian law, including marriages conducted outside Australia if they are recognized in that country.

De facto couples, including same-sex couples, generally need to have been living together for at least 12 months before applying. Registering your relationship may relax this requirement.

You may qualify on de facto grounds if you have been living together for 12 months or longer, provided the relationship is mutually exclusive. This also applies if either party is still legally married to someone else, such as awaiting a divorce.

The Spouse Visa (subclass 820/801 & 309/100) entitles you to:

– Work and study in Australia, though without access to government funding.
– Enroll in Medicare, Australia’s healthcare scheme.
