PROSPECTIVE MARRIAGE VISA (SUBCLASS 300)

The Prospective Marriage visa (subclass 300) is for people who want to come to Australia to marry their prospective spouse.
It is a temporary visa for nine months. You must be outside Australia when you lodge your application and when the visa is granted. You can have the wedding in any country: the wedding does not need to be in Australia.

Eligibility Criteria for Prospective Marriage Visa

To qualify for a Prospective Marriage visa, you must meet the following criteria:

1. Intent to Marry: You must have the intention to marry your prospective spouse.

2. Know Your Prospective Spouse: You must have met and know your prospective spouse.

3. Health and Character Requirements: You must meet the health and character requirements.

4. Age Requirement: You must be at least 18 years of age.

Purpose of Prospective Marriage Visa

The Prospective Marriage visa allows the fiancé(e) of an Australian citizen, permanent resident, or eligible New Zealand citizen to travel to Australia for the purpose of marriage. The marriage must occur within nine to 15 months of the visa grant date. After marriage, the applicant becomes eligible to apply for a Partner visa.

Requirements for Prospective Marriage Visa

Relationship Requirements:

– Both you and your fiancé(e) must be at least 18 years old and not be closely related.

– You must genuinely intend to marry each other within nine months of the visa grant date, with the marriage taking place in Australia or overseas.

– You must have physically met and be personally known to each other.

– You must genuinely intend to live together as a married couple.

Sponsor Requirements:

– Your sponsor must be an Australian citizen, permanent resident, or eligible New Zealand citizen.

– Your sponsor must not have previously sponsored more than one other fiancé, partner, or spouse for migration to Australia, unless there are compelling circumstances.

– Your sponsor must not have been sponsored for a Spouse, Partner, or Prospective Marriage visa by someone else within the last 5 years, unless there are compelling circumstances.

– Your sponsor must provide police checks to the department when requested and consent to disclosing any conviction for a “relevant offence” to the applicant(s) being sponsored.

Please note that sponsorship may not be approved if the sponsor has a conviction for a relevant offence and a substantial criminal history. Relevant offences include but are not limited to offences involving violence, intimidation, breaching a protection order, people smuggling, human trafficking, and weapons.

This visa allows you to:

  • Enter Australia before you marry your prospective spouse.
  • Travel in and out of Australia as often as you want.
  • Work in Australia, although some employers might not hire people with temporary visas.
  • Study in Australia, but with no access to government funding for tertiary study.
  • Apply for a Partner visa, in Australia, after your marriage.

Application Process for Prospective Marriage Visa (Fiance Visa) to Live in Australia

The application for the Prospective Marriage Visa (also known as the Fiance Visa) is submitted to the Department of Home Affairs (DOHA) on behalf of both you and your sponsor. The key criterion is ensuring that your relationship and your sponsor meet the specified requirements. Additionally, you must pass the standard health and character checks.

This visa allows you to stay in Australia for a period of nine to 15 months and enables you to travel to Australia before getting married to your fiancé(e). You must be outside Australia when you apply, but you can be either inside or outside Australia when your visa is granted. The wedding must take place within the validity period of your visa, either in Australia or overseas.

Next Steps: Partner Visa

Once you have arrived in Australia and your marriage has occurred, you become eligible to apply for a Partner visa. This application must be submitted before your Prospective Marriage visa expires. The primary requirements for a Partner visa include:

– Being in a mutually exclusive relationship with your spouse

– Having a genuine and continuing relationship

– Living together as a couple, or temporarily living apart

If you meet the relevant criteria, you will be granted a temporary Partner visa, valid for approximately two years from the date of application lodgement. After this two-year period, you can apply for a permanent Partner visa, provided your relationship still meets the specified requirements.

Note: The estimated time to prepare and lodge your application may take several weeks, depending on how promptly you and your sponsor provide the necessary supporting information and documents.

The processing time for your application by the DOHA depends on its service standards and various other factors, such as the complexity of your case, perceived risk factors, and processing priorities. For current information on processing timeframes, please contact us.

– $8,850 for the main applicant (visa application fee)

– $935 for any child over 18

– $470 for each child under 18 years of age
