PARTNER VISA (SUBCLASSES 820 AND 801)

The Onshore Partner Visa Subclass 820 allows the spouse or de facto partner of an Australian citizen, Permanent Resident, or eligible New Zealand citizen to live temporarily in Australia. This visa is the first step toward obtaining permanent residency through the Partner Visa Subclass 801.

What is the Partner Visa Subclass 820?

The Partner Visa Subclass 820 is a temporary visa that allows non-Australian partners to live and work in Australia while their permanent residency application is being processed.

It’s designed for applicants who are already onshore in Australia, meaning you must be physically present in Australia when you apply for the visa and when it is granted.

You lodge one application form for your temporary and permanent visas and pay one application charge. Your application is processed in two stages, about two years apart.

The temporary Partner visa (subclass 820) lets you:

  • Stay in Australia until a decision is made about your permanent Partner visa
  • Work in Australia
  • Study in Australia, but with no access to government funding
  • Enrol in Medicare, Australia’s scheme for health-related care and expenses.

You can include your dependent children in your application, but not other dependent relatives (unless you hold or held a Prospective Marriage visa). Dependent applicants must be in Australia when they apply.

If you are later granted a permanent visa, you can:

  • Stay in Australia indefinitely
  • Work and study in Australia
  • Apply for Australian citizenship (if you are eligible)
  • Sponsor eligible relatives for permanent residence
  • Receive some social security payments
  • Travel to and from Australia for five years from the date the visa is granted – after that time you will need another visa to enter Australia.

Processing Time for Partner Visa 820

The processing time for the Partner Visa 820 can vary but generally ranges from 12 to 24 months. Delays can occur if the application is incomplete or if additional documents are requested. During this period, you will have access to Medicare and the right to work.

Fees and Costs for Partner Visa 820/801

The Partner Visa 820 application fees cover both the temporary and permanent stages of the process. The standard fee is around AUD 9,095, with additional costs for police checks, medical exams, and document translations. There are no additional fees when transitioning from the 820 visa to the 801 visa.
